By accessing or using Pay With Zest ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

Pay With Zest is a payment platform that enables restaurants and customers to process ACH-based payments with integrated loyalty rewards. The Service includes:

  • Digital wallet functionality for customers
  • QR code-based payment processing
  • Loyalty and rewards program management
  • Merchant onboarding and settlement services

3. User Accounts

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized use
  • Accept responsibility for all activities under your account

4. Payment Terms

For Customers: By initiating a payment through the Service, you authorize us to debit your linked bank account via ACH transfer. You acknowledge that ACH transactions may take 1-3 business days to process.

For Merchants: You agree to pay the platform fees as disclosed during onboarding. Settlement of funds will occur according to the schedule outlined in your merchant agreement.

5. Prohibited Activities

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Engage in fraudulent transactions or money laundering
  • Violate any applicable laws or regulations

6. Limitation of Liability

To the maximum extent permitted by law, Pay With Zest shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

7. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new terms.
